Bell Morgan is a real estate business. We identify and present property opportunities and assist with property-related enquiries and transactions. We do not establish SMSFs, recommend that a person establish or use an SMSF, or provide financial, taxation, legal or credit advice. Where appropriate and with express consent, we may introduce clients to independent qualified professionals.
1. About these Terms
These Website Terms and Conditions (Terms) govern your access to and use of the Bell Morgan website, including property pages, enquiry forms, booking facilities, calculators, downloads, articles, reports, videos, social media content embedded in or linked from the website, and other information or functionality made available through the website.
The website is operated by BMA REAL ESTATE PTY LTD (ABN 41 623 694 744; ACN 623 694 744), trading as Bell Morgan (Bell Morgan, we, us or our).
Your use of the website is subject to these Terms. By continuing to use the website after having a reasonable opportunity to review these Terms, or by actively submitting an enquiry, requesting an appointment or downloading material through the website, you agree to be bound by them.
If you do not agree with these Terms, you should not use the website or submit information through it.
These Terms govern website use and Bell Morgan's preliminary property enquiry and referral activities. A property purchase, reservation, expression of interest, agency appointment, finance application or professional service is governed by the separate agreement and disclosure documents applicable to that transaction or service.
2. Bell Morgan's role
Bell Morgan is a real estate business that identifies and presents property opportunities, including new-build and development properties, using Bell Morgan's property research and assessment criteria.
We may provide property information, discuss your stated property preferences, identify opportunities that appear relevant to those preferences, arrange appointments or introductions, facilitate communications and assist with aspects of a proposed property enquiry or transaction.
Bell Morgan's role is limited to property-related services. Bell Morgan does not establish or administer SMSFs and does not advise whether a person should establish, retain or use an SMSF, transfer or roll over superannuation benefits, borrow through an SMSF or acquire a particular property through an SMSF.
Bell Morgan does not provide financial product advice, personal financial advice, taxation advice, accounting advice, legal advice, conveyancing services or credit assistance. We do not assess whether an SMSF, borrowing arrangement, ownership structure or property investment strategy is appropriate for your financial circumstances.
Unless expressly disclosed in writing, Bell Morgan is not the property developer, builder, vendor, lender, financial adviser, accountant, lawyer, conveyancer, valuer, property manager or SMSF administrator for a property or transaction.
3. General information only
Information available through the website is general information only. It may explain property features, projects, locations, purchasing processes or matters commonly associated with investment property, but it does not take into account your personal circumstances, financial position, objectives, needs, taxation position, legal circumstances, borrowing capacity, risk tolerance or SMSF investment strategy.
Nothing on the website constitutes financial product advice, personal financial advice, taxation advice, legal advice, accounting advice, credit assistance or a recommendation to establish, retain or use an SMSF.
Bell Morgan's identification or presentation of a property does not represent that the property is suitable for you or your SMSF, that your SMSF is permitted or financially able to acquire it, or that the property will produce a particular rental, capital growth, taxation, occupancy, cash-flow or other investment outcome.
You should obtain independent professional advice relevant to your circumstances before making a property, finance, taxation, superannuation, legal or investment decision.
4. SMSF-related enquiries
An SMSF is a regulated superannuation structure. Establishing and operating an SMSF, transferring superannuation benefits, borrowing through an SMSF and acquiring property using SMSF money can involve financial services, superannuation, taxation, lending, trust, legal and property law considerations.
Bell Morgan may receive enquiries from people who already have, or are independently considering, an SMSF and are interested in investment property. Bell Morgan will limit its role to property information and property-related assistance.
Bell Morgan will not recommend that you establish or use an SMSF, advise you to roll over superannuation, determine whether an SMSF is appropriate for you, arrange the SMSF structure or provide advice about the SMSF's compliance, trust deed, investment strategy, borrowing structure or taxation position.
A reference to a property being available for consideration by SMSF purchasers, or potentially capable of acquisition through an SMSF, means only that the property may be considered by a purchaser who proposes to use an SMSF. It is not a statement that the property is suitable for your SMSF or that the acquisition will be legally permissible, financially appropriate or accepted by a lender.
Before establishing or using an SMSF, transferring superannuation benefits, arranging finance or entering a property transaction, you should obtain advice from appropriately qualified and, where required, licensed financial, accounting, taxation, legal and credit professionals.
5. Property selection and research descriptions
Bell Morgan may use property research and assessment criteria to identify properties or locations for presentation to prospective purchasers. Criteria may include matters such as location, infrastructure, population trends, employment, supply, rental demand, price, property type, developer or builder information and other factors Bell Morgan considers relevant at the time.
These criteria are general property-selection tools. They are not a valuation, formal rating, financial product recommendation or personal assessment of whether a property is appropriate for you, your SMSF or your investment strategy.
Terms such as selected property opportunity, investment-focused property, strategic location, growth area, strong rental market, investment-grade or similar expressions, where used, describe Bell Morgan's general research or marketing view at the date of publication. They do not guarantee performance and should not be understood as an independent rating or a representation that the property is the best property available.
The relevance and weight of individual criteria can change over time. You must conduct your own due diligence and obtain independent advice before relying on a property or location description.
6. Property information and third-party sources
Bell Morgan takes reasonable care when preparing and publishing property information. However, information may be supplied by builders, developers, vendors, project marketers, property managers, valuers, researchers, government sources and other third parties.
Property information may include descriptions, prices, availability, plans, dimensions, inclusions, specifications, rental estimates, yield illustrations, construction timeframes, photographs, maps, suburb information and project details.
Bell Morgan does not independently verify every item supplied by a third party. Information can also become outdated or change after publication.
You should verify all information that is material to your decision directly from the relevant source and through your own independent advisers before entering a transaction.
Nothing in this section permits Bell Morgan to make a false or misleading representation or limits responsibility that cannot lawfully be excluded.
7. Prices, incentives and additional costs
Unless expressly stated otherwise, a price displayed on the website is indicative, subject to availability and capable of change or withdrawal before a binding contract is entered into.
A displayed price may not include every cost associated with purchasing, financing, completing, holding, managing, selling or maintaining a property.
Additional costs may include stamp duty, legal and conveyancing fees, loan and valuation fees, registration fees, owners corporation fees, council rates, land tax, insurance, property management fees, repairs, maintenance, SMSF establishment or administration expenses, accounting and audit fees and other government or third-party charges.
Incentives, rebates, grants, concessions and taxation treatments may be subject to eligibility requirements, expiry dates, conditions and individual circumstances. Bell Morgan does not guarantee that you will qualify for a particular benefit.
You should obtain an independent estimate of the total purchase and ongoing costs before entering a property transaction.
8. Property availability and reservations
Property listings are subject to availability. Inclusion of a property on the website does not mean that it remains available, has been reserved for you or can be purchased at a displayed price.
Submitting an enquiry, requesting further information, booking an appointment or verbally expressing interest does not reserve a property.
Any reservation, holding arrangement or expression of interest must be documented and accepted in accordance with the requirements of the relevant vendor, developer, builder or appointed sales agent.
Subject to any non-excludable rights and Bell Morgan's responsibility for its own conduct, Bell Morgan is not responsible merely because a property is sold, reserved, withdrawn, repriced or otherwise becomes unavailable before a binding agreement is entered into.
9. Images, plans and illustrations
Photographs, computer-generated images, artist impressions, display-home photographs, furniture, landscaping, views, streetscapes, maps, plans and illustrations displayed on the website may be indicative only.
Images may show upgrades, decorative items, furniture, appliances, landscaping or finishes that are not included in the purchase price.
Dimensions, boundaries, layouts, perspectives and locations shown in plans or maps may be approximate and may not be to scale.
Views, outlooks, nearby amenities and surrounding development may change over time because of construction, vegetation, planning decisions, infrastructure works and neighbouring development.
You should review final plans, specifications, inclusions, title information, disclosure documents and contract documentation before entering a transaction.
10. Rental estimates, yields and projections
Any rental estimate, vacancy statement, tenant-demand statement, yield, return, cash-flow estimate, capital-growth figure or financial projection displayed on the website is general and illustrative only.
An estimate or illustration may be based on information from property managers or other third parties and assumptions about purchase price, rent, vacancies, interest rates, expenses, taxation, depreciation and market conditions at a particular date.
Actual results may differ materially. Property values and rental income can rise or fall, properties may be vacant, expenses and interest rates may change and past performance is not a reliable indicator of future performance.
Bell Morgan does not guarantee rental income, occupancy, yield, capital growth, cash flow, tax outcomes, resale value or any other investment result.
Where an estimate or projection is material to your decision, you should obtain the source, date and assumptions, test them independently and obtain appropriate financial, taxation, valuation and property management advice.
11. Independent due diligence
You are responsible for conducting investigations appropriate to the proposed transaction before entering into a binding agreement.
Relevant matters may include title, easements, covenants, planning controls, zoning, proposed developments, building approvals, construction risks, defects, environmental matters, flooding, bushfire risk, owners corporation matters, tax implications, finance, insurance, rental demand and the property's suitability for your intended use.
Bell Morgan recommends that you obtain independent legal, financial, accounting, taxation, valuation, building, pest, planning and finance advice as appropriate.
You should carefully review the contract of sale, vendor statement, disclosure documents, building contract, specifications, title documents and all other transaction documents before signing them.
12. Contracts and transaction documents
The website does not constitute a contract for the sale or purchase of property and does not itself create an agency, fiduciary, advisory, lending or professional relationship.
A property transaction becomes binding only when the required transaction documents have been properly executed and any applicable conditions have been satisfied or waived in accordance with those documents.
The relevant contract of sale, building contract, reservation agreement, expression of interest, agency agreement, finance agreement and disclosure documents govern the transaction.
Where information on the website differs from signed transaction documents, the signed transaction documents prevail to the extent permitted by law.
These Terms do not amend or replace any separately executed transaction or professional services agreement.
13. Finance and borrowing capacity
Any website information about deposits, loan amounts, loan-to-value ratios, borrowing capacity, repayments, interest rates or finance structures is general information only.
Bell Morgan does not provide credit assistance and does not guarantee finance approval or that a lender will offer a particular amount, interest rate, term or structure.
Finance approval depends on the lender's criteria, valuation, credit assessment, the borrower's circumstances, the property, the proposed ownership structure and other factors.
SMSF borrowing can involve additional restrictions, documentation, costs, interest rates and structuring requirements.
You should obtain advice from an appropriately licensed credit provider or mortgage broker and should not enter an unconditional contract unless you understand and can meet your obligations if finance is not approved.
14. Taxation and depreciation information
Any information concerning taxation, deductions, depreciation, capital gains tax, negative gearing, land tax, stamp duty or superannuation taxation is general information only.
Tax outcomes depend on individual circumstances and can change if the law, administrative practice or your circumstances change.
Bell Morgan does not guarantee a deduction, refund, concession, depreciation benefit or taxation outcome.
You should obtain advice from a registered tax agent or other appropriately qualified taxation professional before relying on taxation information.
15. Professional referrals
Bell Morgan may, with your express consent, introduce you to independent service providers, including licensed financial advisers, accountants, registered tax agents, lawyers, conveyancers, licensed mortgage brokers, lenders, valuers, property managers, depreciation specialists, SMSF establishment or administration providers, auditors and insurance providers.
An introduction does not mean that Bell Morgan provides or adopts the provider's advice, and does not represent that every provider or service is suitable for you.
You are responsible for deciding whether to appoint a provider and should review the provider's qualifications, licences, experience, fees, terms, privacy policy, conflicts and services.
Any professional services agreement is between you and the provider. The provider is responsible for its own advice, recommendations, decisions, services, licensing obligations and subsequent handling of your personal information.
Bell Morgan remains responsible for its own representations, conduct and referral activities and for complying with obligations that cannot lawfully be excluded.
16. Builders, developers, vendors and project participants
Properties presented by Bell Morgan may be developed, constructed, marketed or sold by independent builders, developers, vendors, project marketers or sales agents.
Bell Morgan does not control the financial position, construction performance, delivery timetable, solvency, conduct or ongoing operations of an independent builder, developer, vendor or other project participant.
Building warranties, defect obligations, completion obligations and contractual commitments are governed by the relevant contract and applicable law.
Bell Morgan does not guarantee that construction will commence or finish by a particular date or that a builder, developer or vendor will continue to trade.
You should conduct appropriate due diligence on the relevant parties and transaction documents before entering an agreement.
17. Commissions, referral fees and commercial arrangements
Bell Morgan may have commercial arrangements with builders, developers, vendors, project marketers and professional service providers.
Bell Morgan may receive a sales commission, marketing payment, referral fee or other monetary or non-monetary benefit when a property is purchased, an introduction results in a service being provided or another agreed event occurs.
The amount and structure of a payment may vary between properties, projects and providers. Where required by law, Bell Morgan will separately disclose a material commission, referral fee, benefit or relationship.
A commercial arrangement does not mean that a property, service provider, loan, SMSF or investment strategy is suitable for you, and does not remove the need for independent advice and due diligence.
Nothing in these Terms authorises Bell Morgan or a regulated third party to give unlicensed advice or accept a benefit prohibited by law.
18. Enquiries and referral consent
When you submit an enquiry, you authorise Bell Morgan to use the contact details you provide to respond to that enquiry and communicate about the property or service you requested.
Bell Morgan will ordinarily seek your express consent before disclosing your contact details or enquiry information to an independent financial adviser, accountant, tax agent, lawyer, mortgage broker, lender, SMSF provider or other professional referral partner.
We will seek to identify the proposed recipient or relevant category of recipient and the purpose of the referral. A referral may include your name, contact details, stated property preferences and information reasonably connected with the requested service.
Consent to a professional referral is separate from consent to receive general marketing communications.
Submitting an enquiry does not oblige Bell Morgan or a third party to provide a service, approve finance, accept an application, reserve a property or proceed with a transaction.
19. Electronic communications and marketing
Bell Morgan may contact you by telephone, email, SMS or another agreed method to respond to an enquiry, provide requested property information, arrange an appointment or communicate about a proposed transaction.
Where you have consented or where otherwise permitted by law, Bell Morgan may also send information about other properties, projects, events, market updates and related services.
You may unsubscribe from marketing communications using the unsubscribe method in the communication or by contacting Bell Morgan. Opting out of marketing does not prevent Bell Morgan from sending communications reasonably necessary to respond to an active enquiry, administer a transaction, provide requested information or comply with a legal obligation.
Electronic communications can be delayed, intercepted, corrupted or accessed without authorisation. Bell Morgan does not guarantee the security or timely delivery of electronic communications, but this does not limit obligations that cannot lawfully be excluded.
20. Privacy
Bell Morgan collects, holds, uses and discloses personal information in accordance with the Bell Morgan Privacy Policy, applicable privacy law and any collection or referral notice presented when information is collected.
The Privacy Policy forms part of these Terms to the extent relevant to website use.
You should not provide tax file numbers, banking passwords, login credentials, identity documents or other highly sensitive information through a general website enquiry form unless Bell Morgan has specifically requested it through an appropriate secure process.
21. Appointments and preliminary consultations
Appointments requested through the website are subject to confirmation.
Bell Morgan may reasonably reschedule or cancel an appointment, including where a representative is unavailable, information is incomplete or the request concerns a service Bell Morgan does not provide.
A preliminary conversation, appointment or consultation does not create a financial advisory, accounting, legal, credit, SMSF administration, agency or other professional relationship unless a separate written agreement establishes that relationship.
22. Calculators, tools and downloadable materials
A calculator, checklist, guide, report or other downloadable resource made available through the website is provided for general informational purposes.
Outputs depend on the information entered, embedded assumptions, calculation methods and data available at the time. They may omit costs, legal restrictions, lender criteria, taxation consequences or other matters relevant to your circumstances.
A calculator result or downloadable resource is not a quote, valuation, finance approval, property recommendation or financial, taxation, legal or credit advice.
You should verify material outputs and obtain appropriate professional advice before acting on them.
23. Testimonials, case studies and examples
Testimonials, purchaser experiences, case studies and examples appearing on the website reflect the circumstances and opinions of the relevant individuals at the time.
They do not represent that every person will receive the same experience or outcome and are not a guarantee of property performance, rental income, capital growth, finance approval or service quality.
Bell Morgan may edit a testimonial for length, spelling or clarity but will not intentionally change its substantive meaning. Any material relationship or incentive connected with a testimonial will be disclosed where required by law.
24. Third-party websites and platforms
The website may link to websites, portals or services operated by builders, developers, financial advisers, accountants, lawyers, lenders, government agencies, social media platforms and other third parties.
Bell Morgan does not control an independent third-party website and is not responsible for its content, availability, security, terms or privacy practices, subject to Bell Morgan's responsibility for its own representations and any rights that cannot be excluded.
A link does not necessarily constitute an endorsement. You should review the relevant third party's terms, privacy policy and credentials before providing information or using its services.
25. Intellectual property
Unless otherwise stated, the website and its content are owned by or licensed to Bell Morgan. Content includes text, property descriptions, graphics, photographs, videos, logos, branding, page layouts, software and downloadable documents.
You may view and download website content for personal and non-commercial use in connection with a genuine property enquiry.
You must not reproduce, republish, modify, distribute, sell, license, scrape, frame, commercially exploit or create derivative works from the website or its content without prior written permission, except where permitted by law.
Third-party trademarks, images, plans and other materials remain the property of their respective owners. Nothing in these Terms transfers intellectual property rights to you.
26. Acceptable use
You must use the website lawfully and in a manner that does not interfere with its operation, security or another person's use.
You must not knowingly introduce malware or harmful code, attempt unauthorised access, circumvent security measures, submit false or misleading information, impersonate another person, use automated tools to extract data in breach of these Terms or use website content for unlawful unsolicited marketing.
You must not use the website for unlawful, fraudulent, abusive, defamatory or misleading conduct.
Bell Morgan may reasonably restrict or block access where it believes that a person has materially misused the website, compromised security or breached these Terms.
27. Website availability and cybersecurity
Bell Morgan aims to keep the website reasonably available and current but does not guarantee uninterrupted, secure or error-free access.
The website may be unavailable because of maintenance, system failure, internet disruption, cybersecurity incidents, third-party outages or circumstances outside Bell Morgan's reasonable control.
Bell Morgan may update, remove or suspend website content or functionality where reasonably necessary, including to protect security or comply with law.
Bell Morgan is not responsible for loss caused solely by temporary website unavailability outside its reasonable control, except to the extent that responsibility cannot lawfully be excluded.
28. Accuracy and correction of errors

29. Australian Consumer Law and other non-excludable rights
Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or another applicable law.
Where Bell Morgan supplies services to a consumer and the law permits liability for failure to comply with a consumer guarantee to be limited, Bell Morgan's liability is limited, at Bell Morgan's option, to supplying the relevant services again or paying the reasonable cost of having the services supplied again.
That limitation does not apply where the law does not permit liability to be limited in that manner.
30. Limitation of liability
To the maximum extent permitted by law, Bell Morgan is not liable for loss arising solely from reliance on general website information where the relevant information was clearly identified as general, the loss was not caused by Bell Morgan's breach of law, negligence, fraud or wilful misconduct, and reasonable verification or independent advice would have avoided the loss.
Bell Morgan is not liable for the independent advice, decisions, products or services of a third-party provider merely because Bell Morgan made an introduction. This does not exclude responsibility for Bell Morgan's own representations, conduct, referral arrangements or choice of provider where responsibility cannot lawfully be excluded.
To the maximum extent permitted by law, Bell Morgan excludes liability for indirect or consequential loss arising solely from use of, or inability to use, the website, including loss of opportunity or anticipated profit, where that exclusion is fair and lawful in the circumstances.
These limitations do not apply to liability arising from Bell Morgan's fraud, wilful misconduct, negligence where liability cannot be excluded, misleading or deceptive conduct, breach of a non-excludable consumer guarantee or any other liability that cannot lawfully be excluded or limited.
31. Your responsibility for decisions
You remain responsible for property, investment, superannuation, finance, taxation and legal decisions you make after considering the information and advice available to you.
You should not rely solely on general information supplied through the website.
Before signing transaction documents, you should confirm that you understand the documents, have obtained advice appropriate to the transaction and can meet the obligations you are assuming.
32. Indemnity for misuse
To the maximum extent permitted by law, you indemnify Bell Morgan against reasonable loss, damage, liability and expense to the extent directly caused by your unlawful use of the website, deliberate or fraudulent submission of false information, material infringement of another person's intellectual property rights or intentional compromise of website security.
This indemnity is reduced to the extent that the loss was caused or contributed to by Bell Morgan or another person and does not apply to the extent that it would be unfair, unlawful or inconsistent with a non-excludable right.
33. Suspension and termination of access
Bell Morgan may suspend or terminate access where it reasonably believes that a user has materially breached these Terms, acted unlawfully, compromised security or used the website in a way likely to cause material harm.
Where reasonably practicable, Bell Morgan will provide notice before restricting access unless immediate action is required to protect security, comply with law or prevent harm.
Termination of website access does not affect rights or obligations that arose before termination.
34. Changes to these Terms
Bell Morgan may update these Terms to reflect changes to the website, services, business operations or applicable law.
The updated version will be published on the website and will state its effective date. Changes apply prospectively and do not retrospectively alter a signed transaction or services agreement.
Where a change materially affects website users, Bell Morgan will take reasonable steps to draw attention to it. Where the law or the nature of the change requires express agreement, Bell Morgan will seek that agreement rather than relying only on continued use.
35. Complaints and disputes
Questions or complaints concerning the website or Bell Morgan's property-related services should first be directed to Bell Morgan using the contact details below.
Bell Morgan will take reasonable steps to consider and respond to a complaint within a reasonable period.
Nothing in these Terms prevents you from contacting a relevant regulator, dispute resolution body, consumer protection agency or court. Depending on the issue, this may include Consumer Affairs Victoria, the Office of the Australian Information Commissioner, the Australian Securities and Investments Commission or another appropriate body.
The parties should attempt to resolve a dispute in good faith before commencing court proceedings, except where urgent relief is required or where doing so would unreasonably restrict a statutory right.
36. Governing law and jurisdiction
These Terms are governed by the laws of Victoria and the applicable laws of the Commonwealth of Australia.
You and Bell Morgan submit to the non-exclusive jurisdiction of the courts and tribunals of Victoria and any courts hearing appeals from them.
If you access the website outside Australia, you are responsible for complying with laws applicable in your location, but nothing in this section excludes rights that apply to you under mandatory law.
37. Severability, waiver and interpretation
If a provision of these Terms is invalid, unlawful or unenforceable, it will be read down to the minimum extent necessary. If it cannot be read down, it will be severed and the remaining provisions will continue to operate.
A failure or delay by Bell Morgan to exercise a right does not constitute a waiver. A waiver is effective only if made in writing by an authorised representative.
Headings are for convenience only. A reference to including or includes is not limiting, and the singular includes the plural where the context permits.
38. Entire agreement concerning website use
These Terms and the Bell Morgan Privacy Policy constitute the agreement between you and Bell Morgan concerning use of the website and preliminary website enquiries.
They do not replace a contract of sale, building contract, agency agreement, reservation agreement, finance agreement, referral consent or professional services agreement entered separately.
